Why rental agreements are usually of 11 months only?

If you have ever put a property on rent or have lived in a rented house, you must have signed a online rent agreement. Have you ever wondered why most Leave and License Agreements are for a duration of 11 months? Often, neither landlords nor tenants or legal services and not even the agents know why this is so. Let's find out.

Also known as a Leave and License Agreement, the online rental agreement is a written contract between the owner of a property (the landlord) and the tenant who takes it on rent. The rental agreement has the terms and conditions such as: details of the property, rent, deposit, duration of the agreement etc.

Rental agreements terms and the conditions can be negotiated but after it is signed, it is binding on both the landlord and tenant. It also specifies the conditions under which the agreement can be terminated. Most of these are available as a standard draft in Maharashtra government's Leave and License Agreement website.

The MAHARASHTRA RENT CONTROL ACT, 1999 (MAH. ACT NO. 18 OF 2000) doesn't specify anything about rent agreement being 11 months.

Where does the perception of 11 months rent agreement come from?

There is no compulsory rule which says that the agreement can be framed only for 11 months. Renewable or extendable agreements for even three to five years can be framed and registered too. However, the stamp duty for the longer duration of time may differ. There is another provision which also state that one can frame the rental agreement for 36 months with a few additional clauses which includes:

Average increase of 5 to 7 per cent on an yearly basis.

Without mentioning any reason for termination, either party can terminate the rent agreement by giving a three month notice in advance

Therefore, in order to avoid the chaos such as vacating the house or disobeying the landlord’s rules and regulation, rental agreement is very important. Visit the property registrar office, pay the stamp duty on the lease tenure and register the lease.
